Woman taken into custody for marijuana related OWI

On Monday, March 22, at 8:11 p.m., a deputy with the Crawford County Sheriff’s Office initiated a traffic stop for an equipment violation on a 1993 Chevrolet Suburban traveling eastbound on Highway 60 near Mara Lane in the township of Wauzeka.

The driver of the vehicle was identified as Maria Aspillaga Hernandez, 29, and John M. Santos, 30, both of Mulberry, Fla. There were four children in the vehicle with ages ranging from 5 months to 4 years old. The deputy detected the odor of marijuana emitting from the vehicle and asked for Santos to exit the vehicle. Santos admitted to there being a gram of marijuana inside the vehicle. A probable cause search of the vehicle was conducted and a green leafy substance, which later tested positive for THC, was located in the vehicle. There were also multiple marijuana smoking devices located in the vehicle. 

Aspillaga Hernandez performed standardized field sobriety tests and was taken into custody for operating a motor vehicle while under the influence of a restricted controlled substance with a passenger under 16 years of age. She was then transported to the Gundersen Boscobel Area Hospital for a blood draw. Aspillaga Hernandez and Santos were both issued citations for possession of THC and drug paraphernalia.

Assisting with this case was the Department of Human Services.
