The parents of a drowned Prairie du Chien boy have appealed the dismissal of their wrongful death lawsuit.
Kurt and Rachael Warrington filed their lawsuit after their son Kashton, 4, was found unresponsive at Wacouta Aquatic Park in Prairie du Chien during a swimming lesson on Aug. 2, 2017.
The lawsuit had alleged that the death occurred because city and Prairie du Chien School District personnel were negligent in their supervision and custody of Kashton.
In November, Judge Craig Day dismissed the case in Crawford County Circuit Court. Day cited Wisconsin’s “recreational immunity” statute which limits a property owner’s liability for an injury to, or caused by, a person engaging in recreational activity on the owner’s property.
