Soldiers Grove man charged with fifth OWI

A 66-year-old Soldiers Grove man has been charged in Crawford County Circuit Court with one count of operating a motor vehicle while intoxicated (fifth or sixth offense), and one count of possession of marijuana.

Mark B. Sherry faces up to 10.5 years in prison and $26,000 in fines if convicted of both counts.

According to the criminal complaint, a state trooper was on duty in the village of Soldiers Grove when he noticed a vehicle with too dark of window tint than is allowed by law. The trooper pulled the vehicle over and smelled the odor of intoxicants when he made contact with the driver.

The driver, Sherry, admitted to the trooper that he had a drink at home, then later said he had a beer and one shot of whiskey. An opened beer about three quarters full was found in the vehicle. During a pat down search, a marijuana pipe with burned material in the bowl was found. Sherry said he had smoked marijuana about an hour before the traffic stop, according to the complaint.

Based on the results of field sobriety tests, Sherry was placed under arrest for OWI.

Sherry has previously been convicted of OWI four times.
