A Crawford County Circuit Court judge released an order last week, modifying the May 22 arbitration decision that said Regal Marine Group had until June 21 to remove its property from the marina premises in Prairie du Chien, and giving the family more time to relocate its belongings.

The Regals now have until Aug. 21—90 days after the arbitration order—to remove personal property, and until Aug. 31 to take down the buildings on the land. Any property deemed abandoned after those dates would become property of the city of Prairie du Chien, according to judge Craig Day.

The Regal family did not contest the arbitration panel’s decision to terminate the lease between themselves and the city; however, all along, they’ve vocalized that the original 30-day timeline to vacate the premises was unreasonable.

“The court concludes that 30 days is not a contractually correct or reasonable time under the circumstances existing at the time of the arbitration,” Day said in his June 27 order. “The court does not concern itself with any offense taken by Regal Marine. Nor does the court concern itself with any environmental obstacles to removal of the buildings. Those environmental obstacles must presumably be cleared. If the buildings are not removed and are then abandoned to the city, [they] become the problem of the city.

“The city accepts a calculated economic risk and obligation by insisting upon prompt removal. Regal Marine likewise has an economic decision to make. The city is entitled to its property and if Regal Marine wishes to not incur the cost of prompt removal, the economics of the situation dictate that removal by Regal Marine should not occur.”

According to a press release issued by the city last week, third parties, or boaters, will retain all rights to their property remaining on the premises. It now becomes the city’s obligation to require removal of that property.

City Administrator Art Osten said, “The city requests that all third parties remove their property as soon as possible. The city intends to create a long-term plan for marina redevelopment and reinvigorate this tremendous river asset for the community’s benefit.”
